О банкротстве

Закон «О восстановлении платежеспособности и банкротстве граждан Республики Казахстан» предусматривает There are three types of procedures – внесудебное банкротство, судебное банкротство и восстановление платежеспособности.

When does out-of-court bankruptcy apply?

If an individual borrower has debts to banks, microfinance organizations, and collection agencies that do not exceed 1,600 monthly calculation indices (5,520,000 tenge), then he may consider an out-of-court bankruptcy procedure. The borrower must comply with the following conditions:

  • на нем не должно быть зарегистрировано имущество, в том числе в общей собственности;
  • на дату подачи заявления, в течение 12 последовательных месяцев, у него должно отсутствовать погашение по обязательствам перед кредиторами, коллекторами;
  • в отношении должника проведены процедуры по урегулированию или взысканию неисполненных обязательств по кредитному договору в сроки, не превышающие 18 месяцев с момента возникновения просроченной задолженности;
  • банкротство не применялось им в течение 7 лет на дату подачи заявления.

Out-of-court bankruptcy can also be applied to by individual borrowers who have not repaid their debts for more than 5 years as of the application date. In this case, the listed conditions do not apply to such a debtor.

Attention! A debtor who has been a recipient of targeted social assistance (TSA) for six months may apply for this procedure without taking into account the delay period. After applying this procedure, the debtor is assigned the status of "bankrupt".

When does judicial bankruptcy apply?

Citizens can apply the procedure for debts over 1,600 MCI (5,520,000 tenge) and for all types of debts owed to creditors.

  • making transactions on the alienation of property;
  • принимать новые обязательства (получение займов, выдача гарантий и поручительств);
  • выезжать заграницу.

После применения данной процедуры должнику присваивается статус «банкрот».

The application is submitted to the court at the debtor's place of residence.

When is the procedure for restoring solvency applied?

Citizens with stable income can apply this procedure. It provides for the possibility of obtaining installments in court to pay debts for up to 5 years. The only condition for a debtor who plans to apply for restoration of solvency is that the amount of debt should not exceed the value of the borrower's property.

Attention! The advantage of this procedure is that the debtor is not assigned the status of "bankrupt". He will not be subject to the restrictions of the "bankrupt". The citizen(s) will be able to travel abroad.

What are the consequences for "bankrupts"?

Debtors who decide to apply for out-of-court or judicial bankruptcy need to know:

  • for 5 years, there will be a ban on loans and micro-loans (except pawnshop micro-loans);
  • повторное банкротство возможно только через 7 лет;
  • будет проводиться мониторинг финансового состояния банкрота в течение 3 лет после банкротства.

Attention! Alimony debts, compensation for damage caused to the life and health of another person, as well as damage caused by criminal offenses are not subject to write-off.
